I argue that compassion entails the experience of feelings that lie in tension with one another. Specifically, I argue that to be compassionate is to simultaneously identify with and feel separated from the regarded individual, and it is to feel empowered in being needed while also feeling powerless to prevent the other's suffering. Previous studies have typically only emphasized one side or the other of this complex dynamic, which has resulted in the phenomenon being cast in radically different directions: as (...) an ethically valuable end to be sought in social relations and, conversely, as a means of affirming one's privilege in an asymmetrical relationship with another person. Macromarketing attempts to address issues that engage marketing and society and previous ethical scholarship has focused on distributive justice and on exchanges that occur in conventional markets. As our research highlights, however, the distributive justice approach alone is insufficient for managing the complexities, ethical paradoxes, and out-of-market conditions associated with wicked, cross-national social concerns. In this article, we integrate macromarketing with the theory of the common good in order to provide a foundation for framing societal change that can encompass nonmarket (...) value, stakeholder rights, collective social priorities, organizational responsibilities, and political action. This paper brings empirical and theoretical studies of ethical leadership into conversation with one another in an effort to determine the antecedent(s) to perceived ethical leadership. Employing a Levinasian perspective, I argue that ethical leadership entails being faced with the impossible task of realizing the needs of many individual others. For this reason, I argue, perceived ethical leadership is grounded in an employee’s perception that a leader struggles to make decisions based on the conflicting demands placed upon her. More important (...) than the result of a leader’s decision is the degree to which the leader demonstrates concern for the well-being of others in her decision-making process. I ground my discussion through reference to results of empirical studies on behaviors associated with ethical leadership, including Brown, Treviño, and Harrison (2005), Kalshoven, Den Hartog, and De Hoogh (2011a), and Treviño, Hartman, and Brown (2000). I identify several mediating factors which may influence employee perception of ethical leadership, proposing avenues for further research which can help to clarify the relationship between concrete leadership behaviors and perceived ethical leadership. Hyperalgesia can arise from peripheral sensitization, on-going peripheral activation, and central plasticity. In the target article, coderre & katz argue that all three mechanisms contribute to hyperalgesia. In contrast, we believe that existing experimental evidence suggests that central plasticity plays only an insignificant role in most experimental models and clinical presentations of hyperalgesia induced by tissue injury or chemical activation of sensory receptors.

Over two decades have passed since the publication of van Gelder's (1998) “dynamical hypothesis.” In that paper, van Gelder proposed that cognitive agents were not digital computers—per the representational computational approach—but dynamical systems. The evolution of the dynamical hypothesis was driven by parallel advances in three areas. Theoretically, a deeper understanding of genetics, biology, neuroscience, and cognitive science inspired questions about how systems within each domain dynamically interact and extend their effects across spatiotemporal scales. Methodologically, more sophisticated and domain-general tools (...) allowed researchers to discover, model, and quantify system dynamics, structure, and patterns across multiple scales to generate a more comprehensive system-level understanding of behaviors. Empirically, we can analyze a system's behavior while preserving its natural dynamics, revealing evidence that the reductionist approach leads to an incomplete understanding of the components and the overall system. Researchers have traditionally reduced a complex system into its component processes and assumed that the parts can be recombined to explain the whole. These three advances fundamentally altered our understanding of a “cognitive agent:” How their behaviors are driven by long-range coordination across multiple processes, how the interdependent and nested structure of interacting variables produces behaviors that are greater than the sum of its parts, and how environmental constraints shape adaptive yet stable behavioral patterns. When faced with a dilemma between believing what is supported by an impartial assessment of the evidence (e.g., that one's friend is guilty of a crime) and believing what would better fulfill a moral obligation (e.g., that the friend is innocent), people often believe in line with the latter. But is this how people think beliefs ought to be formed? We addressed this question across three studies and found that, across a diverse set of everyday situations, people treat moral considerations (...) as legitimate grounds for believing propositions that are unsupported by objective, evidence-based reasoning. We further document two ways in which moral considerations affect how people evaluate others' beliefs. First, the moral value of a belief affects the evidential threshold required to believe, such that morally beneficial beliefs demand less evidence than morally risky beliefs. Second, people sometimes treat the moral value of a belief as an independent justification for belief, and on that basis, sometimes prescribe evidentially poor beliefs to others. Together these results show that, in the folk ethics of belief, morality can justify and demand motivated reasoning. (shrink)

Current orthodoxy takes representation to be essential to computation. However, a philosophical account of computation that does not appeal to representation would be useful, given the difficulties involved in successfully theorizing representation. Piccinini's recent mechanistic account of computation proposes to do just that: it couches computation in terms of what certain mechanisms do without requiring the manipulation or processing of representations whatsoever (Piccinini 2015). Most crucially, mechanisms must process medium-independent vehicles. There are two ways to understand what "medium-independence" means on (...) this account; however, on either understanding, the account fails. Either too many things end up being counted as computational, or purportedly natural computations (e.g., neural computations) cannot be counted at all. In the end, illustrating this failure sheds some light on the way to revise the orthodoxy in the hope of a better account of computation. (shrink)

Since its inception in 2010, the Network for Public Health Law has aligned with federal, state, tribal, and local public health practitioners to assess how law can promote and protect the public’s health. In 2013, Network authors illustrated major trends in public health laws and policies emanating from an internal assessment of thousands of requests for technical assistance nationally. More recently, the Robert Wood Johnson Foundation has invited the Network and other partners to consider new ideas and strategies toward building (...) a “culture of health.” Per Figure 1, RWJF’s conception of a culture of health emphasizes key action areas essential to the promotion of health across all sectors and diverse populations. Public health law research reveals significant complexities underlying the use of law as an effective tool to improve health outcomes across populations. The challenges of applying public health law in practice are no easier. Attorneys, public health officials, and diverse partners in the public and private sectors collaborate on the front lines to forge pathways to advance population health through law. Meeting this objective amidst competing interests requires strong practice skills to shift through sensitive and sometimes urgent calls for action (...) to address known threats to the health of individuals and the community. In an influential paper, Wendy Parker argues that agreement across climate models isn’t a reliable marker of confirmation in the context of cutting-edge climate science. In this paper, I argue that while Parker’s conclusion is generally correct, there is an important class of exceptions. Broadly speaking, agreement is not a reliable marker of confirmation when the hypotheses under consideration are mutually consistent—when, e.g., we’re concerned with overlapping ranges. Since many cutting-edge questions in climate modeling require making distinctions between mutually consistent (...) hypotheses, agreement across models will be generally unreliable in this domain. In cases where we are only concerned with mutually exclusive hypotheses, by contrast, agreement across climate models is plausibly a reliable marker of confirmation. (shrink)

Amalia Holst (1758-1829) has had a rather conflicted reception within the history of feminism. Her Über die Bestimmung des Weibes zur höhern Geistesbildung (On the Vocation of Woman to the Higher Education of the Mind, 1802) is a strident defense of women’s right of access to education; however her case relies on the presuppostion of woman's traditional threefold role as "mother, spouse, and housewife." In this essay, in addition to disclosing new details about Holst's life, I contend that a closer (...) reading of her text reveals a rather more radical project motivating her discussion, and that this helps alleviate concerns about her alleged unoriginality, conservatism, and elitism. Individual and institutional conflict of interests in biomedical research have becomes matters of increasing concern in recent years. In the United States, the growth in relationships — sponsored research agreements, consultancies, memberships on boards, licensing agreements, and equity ownership — between for-profit corporations and research universities and their scientists has made the problem of conflicts, particularly financial conflicts, more acute. Conflicts can interfere with or compromise important principles and obligations of researchers and their institutions, e.g., adherence to accepted research norms, (...) duty of care to patients, and open exchange of information. Disclosure is a key component of a successful conflict policy. Commitments which conflict with a faculty member's primary obligations to teaching, research, administrative responsibilities, or patient care also need attention. Institutional conflict of interests present different problems, some of which are discussed in an analysis of an actual problem posed by two proposed clinical trials. (shrink)

Sometimes it designates moral fairness (as opposed to efficiency or other considerations that are relevant to moral permissibility). Sometimes it designates legitimacy in the sense of it being morally impermissible for others to interfere forcibly with the act or omission (e.g., my failing to go to dinner with my mother may be wrong but nonetheless (...) legitimate). Finally, sometimes it designates what we owe each other in the sense of respecting everyone’s rights. Of course, these notions are closely related. What we owe each other may, but need not, be partly based on issues of fairness. Legitimacy and permissibility of political structures are largely, but perhaps not entirely, determined by what rights of non-interference individuals have. Nonetheless, these are distinct notions and we shall focus only on what we owe each other. Justice as what we owe each other is not concerned with impersonal duties (duties owed to no one, i.e., that do not correspond to anyone’s rights). If there are impersonal duties, then something can be just but nonetheless morally impermissible. For brevity, we shall often write of actions being permissible or agents having a moral liberty, but this should always be understood in the interpersonal sense of violating no one’s rights. Libertarianism is sometimes advocated as a derivative set of rules (e.g., derived from rule utilitarian or contractarian doctrines). (Studies in the History of Greece and Rome)“Nothing could have contributed more to the safety, strength and profit (...) of the state.” Thus Niccolò Machiavelli (Disc. II 6), one of the first of a long line of moderns to expatiate on the phenomenon of Roman Republican colonization. The latest (at time of writing) is D. J. G[argola], with his learned Lands, Laws, & Gods, which has its origins in the author’s 1989 University of North Carolina dissertation. The book takes as its general subject not just Republican colonization but also another well-trod area of Roman public policy—the agrarian legislation that distributed state land and regulated its use—as well as the religious and technical aspects of Roman land definition.Can we really expect much new on these traditional topics? Perhaps not, [End Page 143] especially now that we have Dieter Flach’s Römische Agrargeschichte (Handbuch der Altertumswissenschaft 3.9, Munich 1990)—a masterly synthesis that G. oddly has missed. Yet G. independently manages to come up with a work of value. The bulk of G.’s book (chapters 2–7) consists of detailed reconstructions, especially from the evidence of Livy 21–45 (not much used by Flach), of how colonies were established, viritane plots assigned, and land sold or leased in the mid-Republic. Here G. has sifted through a small mountain of difficult evidence (and bibliography) of widely varying worth and succeeded in shaping a coherent narrative. He has a keen eye for technical and conventional language, and sound judgment on the limits of applying evidence from the various Gromatici (none of whom were writing much before the second century a.d.) to the Republican situation. In short, G. in these pages has crafted a reliable and readable English language work of reference on all sorts of res agrariae.The emphasis in chapters 2–7 is not so much on evolution in the administration of agrarian and colonial legislation—G. argues (somewhat provocatively) that there was not much development of institutions within this period—but on creating a composite picture of how things worked. G. realizes “the result is necessarily an idealized portrait,” in which the system appears more regular than it perhaps was (10–11). One additional trouble, however, is that this approach sometimes flattens potentially significant details. Take for instance the two commissions of colonial IIIviri created under a lex Aelia of late 194 (Liv. 34.53.1–2), one of which went on to found Copia (193), the other Valentia (192). Now, the reported terms of this law provided that the commissioners hold imperium—quite striking, though G. misses that detail—for three years (i.e., 193–91) to colonize the ‘ager Thurinus’ and the ‘Bruttii’ respectively. G. is over-optimistic in calling these territories “stable, long pacified regions” (63). If so, why the imperium? One possible explanation. The territorial parameters placed on each of these commissions (especially ‘the Bruttii’) were quite loose. Those IIIviri may have been expected to take wide-ranging measures to strengthen Roman control over dissidents in this area (cf. App. Hann. 61.252–53), even after they established their colonies. (Note that each of these commissions completed their ostensible tasks before their triennium expired.) If true, how many other colonial commissions were like these?It is only in chapters 8 and 9, where G. surveys agrarian programs from the Gracchi to the end of the Republic, that we see an attempt to show real development. The Gracchi in their agrarian legislation sought to achieve broader effects than any of their predecessors, argues G. in chapter 8, and so introduced agrarian laws that “ended the rigid separation of categories found in mid-Republican legislation” (176). Consider the lex Sempronia agraria of 133, which, in its final form, established IIIviri a(gris) i(udicandis) a(dsignandis) to settle coloni on public land taken from illegal possessores. For many persons, ‘Holocaust‐abomination’is a fixed point on their moral compass: if anything can be evil, it was. Yet at least one of the justifications deployed by its perpetrators (the eugenics argument) invokes widely‐held values concerning human health and procreation. Hence persons endorsing many current activities based on those values (e.g. genetic counselling) have been charged with being on a morally deplorable slippery slope. In a recent review essay of a two volume anthology on left-libertarianism (edited by two of us), Barbara Fried has insightfully laid out most of the core issues that confront left-libertarianism. We are each left-libertarians, and we would like to take this opportunity to address some of the general issues that she raises. We shall focus, as Fried does much of the time, on the question of whether left-libertarianism is a well-defined and distinct alternative to existing forms of liberal egalitarianism. (...) Few scholars have investigated the considerations of over-empowered teams from a non-consequential ethics approach. Leveraging a virtue-based ethics lens of team empowerment, we provide a framework of team ethical orientation and over-empowerment using highly influential market research teams as a basis for our analysis. The purpose of this research is to contrast how teams founded on virtue-based ethics can attenuate ethical dilemmas and negative organizational outcomes from team over-empowerment. We provide a framework of four conditions that include Sophisticated, Suppressed, Contagion, (...) and Impeded to discuss alignment between team ethical orientation and team empowerment. Through this framework, we aim to further our understanding of empowered team behavior between action that is virtuous, moral, and ethical and activity that threatens organizational values and goals. Live donor kidney transplantation is the best treatment option for most patients with late-stage chronic kidney disease; however, the rate of living kidney donation has declined in the United States. A consensus conference was held June 5-6, 2014 to identify best practices and knowledge gaps pertaining to live donor kidney transplantation and living kidney donation. Transplant professionals, patients, and other key stakeholders discussed processes for educating transplant candidates and potential living donors about living kidney donation; efficiencies in the living donor (...) evaluation process; disparities in living donation; and financial and systemic barriers to living donation. We summarize the consensus recommendations for best practices in these educational and clinical domains, future research priorities, and possible public policy initiatives to remove barriers to living kidney donation. Mucopolysaccharidosis type I (MPS I) is a rare lysosomal storage disorder treated with bone marrow transplantation or enzyme replacement therapy with laronidase, a high-cost orphan drug. Laronidase was approved by the US Food and Drug Administration and the European Medicines Agency in 2003 and by the Brazilian National Health Surveillance Agency in 2005. Many Brazilian MPS I patients have been receiving laronidase despite the absence of a governmental policy regulating access to the drug. Epidemiological and treatment data concerning MPS I (...) are scarce. This study aims to present a demographic profile of Brazilian patients with MPS I, describe the routes of access to laronidase in Brazil, and discuss associated ethical issues relating to public funding of orphan drugs. Piscator and its other professors. The brief evaluations have been written by seven professors: J. Matthaeus, H. Gutberlet, H. Ravensperger, J. H. Alsted, H. Dauber, G. Pasor, J. J. Hermann, who all have expressed a predominantly positive opinion about the study (...) and conduct of Czech students. During the last several decades, the concept of social innovation has been a subject of scientific and practical discourse. As an important paradigm for innovation policies, social innovation is also an object of criticism and debate. Despite a significant proliferation of literature, the rate at which social innovation is a catalyst for coping with challenges of modern societies remains unclear. The goal of the paper is to gain a better understanding of social innovation by integrating past and present views on (...) the concept. Applying a historical overview covering the period from the 19th to the 21st century, we outline the milestones in the evolution of social innovation and distinguish seven trajectories that illustrate the commonalities in its interpretation. We consolidate the findings into a three-dimensional model that defines social innovation as an intervention that is targeted toward structural changes within a social dimension that, in terms of different functional settings (e.g., technological, business, organizational), are oriented on systemic improvements of societies. Reflecting on future avenues, we consider social innovation as an integrative part of a holistic intervention that acts across single societal dimensions and provides systemic impact for the sustainable development of societies.
